These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 18.12.2013. In response, the Deputy Commissioner of Police, East District, Delhi, vide his communication dated 10.1.2014 has submitted the report. The relevant part of the report is reproduced below:- "In this regard, it is submitted that an interim compensation of Rs. One Lac was granted to the victim in case FIR No.146/13 u/s 363/366 A/376(D)/377/342/307/201/34 IPC & 5(m,1,r.g,)/6 POCSO Act, PS Gandhi Nagar under clause 8 of the Delhi Victim Compensation Scheme, 2011 by Delhi State Legal Services Authority as compensation for welfare and rehabilitation of victim in above mentioned case. It is also learnt that several prominent persons have also donated amount to the deceased in their own capacity. It is also informed that DE against Inspector Dharmendra Pal Singh No.D/3299 then SHO/PS Gandhi Nagar and SI Mahabir Singh, No.4469/D, initiated vide order No.3158-78/P. Cell/Vig. (P-II) dt. 27.4.2013, which is held-in-abeyance by the CAT. As the delinquents had filed OA No.2447/13 & MA No.1745/13 for the change of the E.O. and demanded certain documents. However, 14 PWs out of 19 have already been examined by the E.O. Matter is already sub-judice & decision will be taken after receiving direction from the CAT." A similar report dated 22.1.2014 has also been received from SDM, Gandhi Nagar, Delhi stating that financial relief of Rs. One Lakh has been paid to the victim. The Commission has considered the matter. Financial relief as per policy of the Government has already been paid to the victim. The Departmental action against the delinquent police personnel has already been initiated and is now sub judice before Central Administrative Tribunal. The criminal case registered in the matter is pending trial in the court. No further action is called for. The reports are taken on record and the case is closed. These proceedings shall be read in continuation of the earlier proceedings of the Commission dated 17.06.2013, vide which the SP, Kaithal, was directed to submit present status of investigation of the case. The Deputy Commissioner, Kaithal, was directed to inform the Commission as to what steps have been taken for payment of monetary relief to the victim under Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. Pursuant to the directions of the Commission, the SP, Kaithal, has submitted his report dated 31.07.2013, in which it is stated that a chargesheet has been submitted U/S 363/365/366-A/376 (2)(g)/506 IPC and U/S 3 (1) (12) of Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act. Another report dated 16.08.2013 has been received from the Deputy Commissioner, Kaithal, in which it is stated that Rs.65,000/- have been given to Shri Lal Singh, father of the victim. A photocopy of the cheque is annexed with. The Commission has perused and considered the reports. It is clear from the report of the SP that chargesheet has been filed in the matter. The matter is sub-judice and required monetary relief has been paid. Hence, no further intervention of the Commission in the matter is required and the case is closed.

This case pertains to the death of new born child and mother due to blood bank error and supply of wrong blood to be infused to her. The Commission vide Proceedings dated 12.6.2013 observed and directed thus : "In response, the Commission has received a reply dated 11/12/12 from the Special Secretary, Health and Family Welfare Deptt., Govt. of NCT of Delhi that due to the negligence of the laboratory technician blood of the wrong group was issued for transfusion to the patient. The hospital administration, taking a serious view of the matter, took most stringent action possible against the said official by removing him from service. However, as the next of kin of the deceased did not agree on the advice of hospital administration to conduct the postmortem, the precise cause of the death could not be ascertained. The hospital administration has taken necessary action to prevent such instance. The Commission has considered the material placed on record and observes that a precious life was lost due to the negligence / mistake of the technician posted in the blood bank who issued blood of the wrong group for transfusion to the patient. For such negligent mistake the State must bear vicarious liability. The Commission, therefore, recommends to the Govt. of NCT of Delhi through its Chief Secretary to pay compensation of Rs.4,00,000/-(four lakh only) to the next of kin of the deceased Priya. The proof of payment is to be submitted within six weeks." Pursuant to the directions of the Commission, the Dy. Secretary (H&FW), Govt. of NCT Delhi, Health & Family Welfare Department, New Delhi submitted the compliance report alongwith proof of payment. The NoK of the victims have been paid compensation amount of Rs. 4,00,000/-, therefore, the Commission is not inclined to proceed further in the matter. The case is closed. The complainant and NoK of the victims be given a copy of this Proceedings. LINKED WITH MAIN FILE NO.6780/30/0/2011.

विषय : उत्तर प्रदेश के हमीरपुर जिले के थाना सुमेरपुर में थाने के अन्दर पुलिस वालो ने महिला के साथ दुष्कर्म किया, महिला की रिपोर्ट न लिखने और पुलिस कर्मियों द्वारा उसे भगा दिए जाने के सन्दर्भ में |


महोदय,

      आपका ध्यान 12 जून 2014 को दैनिक समाचारपत्र अमर उजाला की इस खबर "हमीरपुर में खाकी पर दाग, थाने में दरोगा ने किया रेप" की और आकृष्ट कराना चाहता हूँ | उत्तर प्रदेश के हमीरपुर जिले के थाना सुमेरपुर में दरोगा राहुल पाण्डेय ने थाना परिसर आवास में महिला के साथ बलात्कार किया | महिला अपने पति को थाने से छुडवाने के लिए आयी थी | परन्तु दरोगा ने रुपये 20000/ उसके पति को छोड़ने के एवज में मांगे | महिला ने पैसे न होने की बात कही तब दरोगा व अन्य तीन सिपाहियों ने महिला के दुधमुहे बच्चे को उससे छीन कर उसके साथ बलात्कार किया |

      महिला ने इसकी शिकाया पुलिस के उच्च अधिकारियो से की परन्तु उसे भगा दिया गया |

      कृपया इस मामले को संज्ञान में लेते हुए दोषी पुलिसकर्मियों पर केस दर्ज कर कार्यवाही का आदेश देने की व पीड़ित महिला को उचित मुआवजा दिलाने की कृपा करे |

      आपका ध्यान 28 मई, 2014 के दैनिक समाचार पत्र दैनिक जागरण के इस खबर "निर्मम पिटाई से महिला का गर्भपात" की ओर आकृष्ट कराना चाहता हूँ | उत्तर प्रदेश के ललितपुर जिले के थाना बानपुर के गाँव सिमिरिया में दबंगों द्वारा गर्भवती महिला को उनके कुंए से पानी पीने पर दबंगों द्वारा उसे बेरहमी से पीटा और उसका गर्भपात हो गया | पुलिस द्वारा इस मामले में हीला हवाली कर रफा दफा करने की कोशिश की जा रही है |

      कृपया इस मामले को संज्ञान में लेते हुए न्यायोचित कार्यवाही करने की कृपा करे और घायल महिला को उचित मुआवजा दिलाने की कृपा करे |
