The NHRC has received a complaint from Dr. Lenin Raghuvanshi, a human rights activist from Varanasi, Uttar Pradesh alleging that in Balasore district of Odisha, a journalist Loknath Dalai was severely beaten up by the police and he is being treated in a hospital. He has also alleged that the victim has been tied with the bed by the police. The complainant has requested the Commission to intervene into the matter.

After considering the report received from the concerned authority, the Commission invited comments from the complainant. The letter to the complainant was issued on 10.8.2022 through email, however, no comment has been received from the complainant.

As per the report, FIR No. 146/2022 was registered u/s 341/323/294 and other relevant sections of the IPC at PS Nilagiri against Niranjan Rana. During the investigation, the complainant as well as the witnesses was examined. The accused Loknath was arrested as per provisions of 41 Cr.P.C. All procedures for medical examination were complied with. It is further submitted that the accused was arrested as per the procedure. However, there was no instructions from any superior officer, either orally or in writing to Havildar C.R. Singh and the guard party to put handcuffs to the accused Loknath. After the preliminary enquiry, Havildar C.R. Singh has been placed under suspension. The accused Loknath was discharged from DHH, Balasore on 11.4.2022. As it has been admitted in the report submitted by the concerned authority that the accused Loknath was handcuffed by Havildar C.R. Singh without any oral or written order from the superior authority and departmental proceeding have been initiated against him.

In the opinion of the Commission, violation of human rights of the victim has been prima facie made out and the State is vicariously liable for the acts of negligence of its servants and is liable to pay monetary compensation to the victim.

Issue notice u/s 18(a) of Protection of Human Rights Act, 1993 to Government of Odisha through its Chief Secretary, to show cause notice as to why the Commission should not recommend monetary relief of Rs. 5,000/- (Rs. five thousand only) to the victim Loknath.

Response within four weeks positively.

उड़ीसा HC ने NHRC के आदेश के खिलाफ सरकार की याचिका खारिज कर दी

उड़ीसा उच्च न्यायालय ने राष्ट्रीय मानवाधिकार आयोग (एनएचआरसी) के आदेश के खिलाफ हस्तक्षेप करने से इनकार कर दिया है, जहां उसने राज्य सरकार को कटक और खुर्दा के विभिन्न हिस्सों में मारे गए 40 व्यक्तियों में से प्रत्येक के परिवार को 1.5 लाख रुपये का भुगतान करने का निर्देश दिया था। जिले में जहरीली शराब का सेवन कर रहे हैं।

जहरीली शराब त्रासदी फरवरी 2012 में हुई थी। मानव अधिकार जन निगरानी समिति (उत्तर प्रदेश) के शासी बोर्ड के सदस्य रागिब अली की याचिका पर एनएचआरसी ने 11 फरवरी, 2015 को आदेश जारी किया था। लेकिन राज्य सरकार ने अगस्त 2015 में इसे हाईकोर्ट में चुनौती दी।

मंगलवार को मुख्य न्यायाधीश एस मुरलीधर और न्यायमूर्ति एम एस रमन की खंडपीठ ने याचिका को खारिज करते हुए कहा, "अदालत ने नोट किया कि अन्यथा भी आकस्मिक मृत्यु के लिए, राज्य सरकार द्वारा आमतौर पर 1,50,000 रुपये की अनुग्रह राशि का भुगतान किया जाता है। एनएचआरसी ने स्वयं नोट किया कि न्यायमूर्ति नायडू आयोग ने पीड़ितों के परिवारों को ऐसी राहत के भुगतान की सिफारिश पहले ही कर दी है। नतीजतन, अदालत हस्तक्षेप करने के लिए राजी नहीं है। ईंट भट्ठा श्रमिकों की अवैध शराब से हुई मौतों के बाद उच्च न्यायालय के एक सेवानिवृत्त न्यायाधीश जस्टिस एएस नायडू को जांच आयोग नियुक्त किया गया था। इस घटना ने राज्य को झकझोर कर रख दिया और आबकारी मंत्री एयू सिंहदेव को नैतिक आधार पर इस्तीफा देना पड़ा।

जस्टिस एएस नायडू जांच आयोग ने अप्रैल 2013 में अपनी रिपोर्ट सौंपी जिसमें पुष्टि की गई कि 41 लोगों की मौत जहरीली शराब युक्त दूषित औषधीय तैयारी के सेवन से हुई थी। आयोग ने 40 मृतकों के परिवारों को मुआवजे के रूप में 1.5 लाख रुपये के भुगतान की सिफारिश की थी, हालांकि 41 लोगों की मृत्यु हो गई थी। त्रासदी। आयोग मृतकों में से एक को नुकसान का भुगतान करने के लिए इच्छुक नहीं था क्योंकि वह नकली शराब के अवैध विक्रेताओं में से एक था। राज्य सरकार ने न्यायिक आयोग की रिपोर्ट को स्वीकार किया, लेकिन पीड़ितों के परिवारों को मुआवजा नहीं देने का फैसला किया। क्रेडिट : newindianexpress.com

Subject: Additional Information Called for -1394/20/5/2022.
 
Sir/Madam,
 
         I am directed to say that the matter was considered by the Commission on 09/01/2023 and the Commission has directed as follows.:
 
 
         

The Commission has received a complaint from Dr. Lenin Raghuvanshi, a human rights activist from Varanasi, Uttar Pradesh referring to a news report published in Dainik Bhaskar on 08.04.2022 revealing that a girl student of DPM College, Bharatpur, Rajasthan has been subjected to torture in the name of raging due to which the girl student died. The complainant has requested the Commission to intervene into the matter.

Vide previous proceeding, the Commission observed and directed as under:-

“Pursuant to the aforesaid directions a report has been received whereby it is stated that on the basis of information received, the girl-victim was being eve teased by some boys who were troubling the victim and used to pressurize the victim to have a relation with them. A case was registered U/s 143,341,328, 306 IPC and statements of the victim's father and mother were recorded U/s 161 Cr.P.C. Further, a number of witnesses have also been examined and their statements were recorded and also were video graphed. The post mortem report of the victim was also obtained from RBM Hospital and viscera samples were also sent to SMS Hospital Jaipur and also to FSL Bharatpur.

The students who were studying with the victim, namely, Bhavna Saini and Raveena Gujar and those students who used to travel with the victim, namely, Radha, Neetu and Komal their statements have also been regarding the incidents that transpired on 05.04.2022, which has revealed that the victim was neither chased nor harassed while she was coming back from college nor was she forcibly made to drink or eat anything.

Notably, the report states that the witnesses Chandrabhan and Amit in their statements have said that on 04.04.2022 the accused Naresh and Vikam had come the deceased's college and harassed her. The said accused was also interrogated and information elicited from them has also been taken on record. The reports from SMS Hospital Jaipur and FSL Bharatpur are awaited.

In view of the detailed report, the Commission is of the considered view that no further intervention of the commission is required in the matter, as the investigation is conducted in a fair manner and the Law shall now take its due course.

As far as the arrest of the accused persons is concerned, they be arrested forthwith and investigation be completed at the earliest in the case.

Let the State Government show cause within 6 weeks, as why a compensation of Rs. 10 lakhs should be ordered to the next of kin of the victim.

List after 8 weeks.”

Pursuant to the directions of the Commission, a reply has been received from the Deputy Secretary, Administration, stating therein that as per the report submitted by SP, Bharatpur, allegations of ragging and giving poison to the deceased could not be substantiated.   A final report has been submitted on the ground of mistake of fact.   In these circumstances, it is not appropriate to give compensation of Rs. 10 lakhs to the NOK of the deceased in this present case.

A report from SP, Bharatpur has also been received in the Commission, stating therein that in the present case, after the investigation, a final report has been submitted in the concerned court of ACJM, Bair.

In view of the above ,it is deemed appropriate to call for the copy of the final report . The concerned authority is directed to submit the copy of the Final report along with the documents within four weeks  positively.

  


 

 
 
2.          It is therefore, requested that the additional/complete report as directed by the Commission in the matter be sent latest by 16/02/2023, for futher consideration by the Commission.
