Subject: Action Taken Report Called for(ATR) -27345/24/72/2021.

Sir/Madam,

The complaint/intimation dated 24/09/2021, was placed before the Commission on 11/11/2021. Upon perusing the same, the Commission directed as follows:

The Commission has received a complaint from Dr. Lenin Raghuvanshi, a human rights activist from Varanasi, Uttar Pradesh alleging that on 11.08.2021, one Raj Kumar Mishra, aged 42 years died due to electrocution in Varanasi district of Uttar Pradesh due to negligence by the Electricity department. The victim has left behind, two young children and wife. The complainant has requested the Commission to intervene into the matter so that fair investigation is conducted and suitable compensation is awarded to the victim’s family.

Transmit a copy of the complaint to the Chairman-cum-Managing Director, Uttar Pradesh Power Corporation Limited, Lucknow and the Commissioner of Police, Varanasi, Uttar Pradesh calling for a report in the matter within 4 weeks.

The Commission shall be constrained to invoke coercive process u/s 13 of the Protection of Human Rights Act, 1993 calling for a personal appearance of the authority concerned for submission of the report, in case the report is not received within the stipulated time.

2. Accordingly, I am forwarding herewith a copy of the complaint/intimation as an attachment for taking appropriate action in the matter as per the directions of the Commission. It is requested that an Action Taken Report be sent to the Commission within 4 weeks from the date of receipt of this letter.

3. Any communication by public authorities in this matter may please be sent to the Commission through the HRCNet Portal (https://hrcnet.nic.in) by using id and password already provided to the public authorities (click Authority Login), or through Speed Post/ at email-id cr.nhrc@nic.in. Any Audio/ Video CDs/ pen drives etc. and bulky reports may be sent through Speed Post/ per bearer.

महोदय,

जनमित्र न्यास/मानवाधिकार जननिगरानी समिति द्वारा वाराणसी जिले के बडागांव, हरहुआ, पिंडरा, अराजीलाईन एवं बजरडीहा (मुस्लिम बाहुल्य क्षेत्र) में मातृत्व शिशु एवं बाल स्वास्थ्य में मुद्दे पर जागरूकता बढ़ाने के साथ - साथ वंचित समुदाय का शासन द्वारा संचालित योजनाओं में पहुंच बनाने का कार्य किया जाता है |

विदित हो कि, समिति अपने मातृत्व शिशु एवं बाल स्वास्थ्य के मुद्ददे पर जमीनी स्तर पर कार्य करने के दौरान यह अनुभव मिला कि, से मार्च 2021 से गर्भवती महिलाओं को आयरन एवं कैल्शियम की गोली, किशोरियोंकोआयरन की गोली एवं बच्चों को आयरन सिरप नियमित नही मिल पा रहा है | जबकि कोविड के दूसरी लहर के बाद से वंचित समुदाय जंहा आर्थिक तंगी के कारण परिवार भरण पोषण न्यूनतम साधनों में करने को विवश है,परिवार के सदस्यों का स्वास्थ्य एवं पोषण स्तर बहुत ही खराब हो गया है | ऐसे में उन्हें इस प्रकार के सप्लीमेंट्स की अत्यधिक आवश्यकता है जिससे कि, उनके शरीर में आवश्यकसूक्ष्म पोषक तत्वों की पूर्ति किया जा सके एवं गर्भस्थ शिशु का विकास हो सके |

ऐसे में गर्भवती महिलाओं को आयरन और कैल्शियम की गोली समय से नही मिलने, कम संख्या में मिलने की शिकायत है कई गर्भवती महिला का जिनका प्रसवआज के समय हो गया है किन्तु, उन्हें आयरन और कैल्शियम की गोलीनही मिल पाया है, ऐसे में गर्भस्थ शिशु एवं गर्भवती महिला को अति आवश्यक सूक्ष्म पोषक तत्वों के अभाव में शिशु को जन्म देना पड़ रहा है |

महोदय, अपने लक्षित कार्यक्षेत्र में मार्च से अब तक की गर्भवती महिलाओं जिनकी कुल संख्या 170 है (कुल गर्भवती 170

( पहली तिमाही की 9 गर्भवती दूसरी तिमाही की 77 गर्भवती तीसरी तिमाही के 84 गर्भवती ) जिनमें से मात्र 69 महिलाओं को ही आयरन की गोली मिल पाया वंही, 101 महिलाओं को आयरन की गोली नही मिल पाया |

इसी प्रकार कुल 170 महिलाओं में मात्र 46 महिलाओं को कैल्शियम की गोली मिला शेष 124 महिलाओं को कैल्शियम गोली नही मिल पाया |

जिन महिलाओं को आयरन की गोली प्राप्त हुआ है उन्हें भी नियमानुसार 180 गोली नही मिला है, मात्र 5 महिलाओं को 100 से 130 गोली प्राप्त हुआ है वंही 35 महिलाओं को मात्र 20 गोली ही मिल पाया है |

इसी प्रकार यदि कैल्शियम की गोली की स्थिति देखें तो वह भी बहुत ही चिंताजनक स्थिति में है, मात्र 17 महिलाओं को केवल 20- 20 गोली ही मिल पाया है |

स्वस्थ्य शिशु के जन्म एवं सुरक्षित प्रसव के लिए बेहद आवश्यक सूक्ष्म पोषक तत्वों के अभाव में शिशुओं एवं बच्चो में विभिन्न प्रकार की विकलांगता व् जन्मजात विकृति, कुपोषण, माताओं के स्वास्थ्य में चुनौती आदि गम्भीर परिणाम आ सकतें हैं, अत: हमारा विनम्र निवेदन है कि, उपरोक्त समस्या को संज्ञान में लेकर अविलम्ब उचित कार्यवाही एवं विभागीय दिशा निर्देशन किया जाएजिससे सुरक्षित मातृत्व एवं स्वस्थ्य शिशुओं का जन्म हो और वे कुपोषण मुक्त हों |

Subject: Additional Information Called for(AIC) -28307/24/72/2021.

Sir/Madam,

I am directed to say that the matter was considered by the Commission on 13/12/2021 and the Commission has directed as follows.:

     The present matter pertains to alleged exploitation and murder etc. of brick kiln workers on demand of their due payments.

Vide proceedings dated 04.10.2021 this Commission took cognizance and has observed/directed as under:-

“Instant complaint from a Human Rights Defender   relates to allegations of denial of payment/ legtimate dues to labourers of   named brick kiln factory located in   District-Jaunpur (UP) and murder of one of the labourer   and grevious injuries to others, on 10-6-2021,   by the owners of that unit   when   a demand for   payment of dues was taken up with the owner and thus is seeking intervention of the Commission in the matter.

The Commission directs its Registry to transmit the copy of complaint to the concerned authority calling for an action taken report within four weeks.

The concerned authorities shall also intimate the Commission, if any, notice, order etc., has been received by him/them in the instant matter from the State Human Rights Commission? If yes, a copy of such order be also sent to the Commission within four weeks.

Let a copy of the complaint be also transmitted to the Secretary of the concerned State Human Rights Commission, calling upon him to inform this Commission the date of cognizance, if any, taken at their end in the instant matter within four weeks.”

No report is received.  Registry is directed to issue fresh reminder to District Magistrate, Jaunpur, Uttar Pradesh as well as Superintendent of Police, Jaunpur, Uttar Pradesh to submit the requisite report within six weeks positively failing which this Commission will be constrained to invoke its coercive powers u/s 13 of PHR Act. 1993.

2. It is therefore, requested that the additional/complete report as directed by the Commission in the matter be sent latest by 03/02/2022, for futher consideration by the Commission.
