The complaint/intimation dated 03/08/2022, was placed before the Commission on 04/08/2022. Upon perusing the same, the Commission directed as follows: |
The complainant, in the instant case, has alleged regarding death of one prisoner Ramsagar, aged 45 years, on 2.8.2022, while being in judicial custody of District Jail- Ambedkarnagar, Uttar Pradesh. The Commission takes cognizance of the matter and directs the District Magistrate, Ambedkarnagar, Uttar Pradesh, the Superintendent of Police, District-Ambedkarnagar, Uttar Pradesh and Superintendent, District Jail- Ambedkarnagar, Uttar Pradesh (through IG-Prison ) to send the following reports to the Commission within eight weeks: i) Detailed report, covering all the aspect leading to death ii) Initial health screening report, as per NHRC format.(including report of previous jail, if applicable) iii) Complete medical treatment records, including previous jail, if applicable. (a brief medical summary in chronological order should be made available mentioning ailment(s) and in-door/outdoor treatment given to the deceased) iv) Inquest panchnama v) Postmortem examination report ( a typed copy must be provided) vi) CD of postmortem examination vii) Chemical examination of viscera (if applicable) viii) Histopathology examination of viscera (if applicable) ix) Final cause of death based on FSL report (if applicable) x) Magisterial enquiry report Following reports, if applicable, may also please be sent: i) Action Taken Report on the Magisterial Enquiry Report ii) Final Outcome/Status of Departmental action or criminal proceedings iii) CB/CID Inquiry Report, if applicable. The Registry is also directed to take up the matter with the Uttar Pradesh State Human Rights Commission to inquire whether they have taken cognizance of this case of death in judicial custody, if so, the date of cognizance to be obtained from the State Human Rights Commission. |

The complaint/intimation dated 23/07/2022, was placed before the Commission on 26/07/2022. Upon perusing the same, the Commission directed as follows: |
The complainant , based on media reports, has alleged that one Sajeevan Kalleri, aged 42 years , R/o Vadakara, died on 22.7.2022, due to brutal assault by the police of PS. Vadakara , District-Kozhikode, Kerala. It is stated that the victim was assaulted and tortured by the police, which was witnessed by the deceased friend. The complainant is seeking intervention of the Commission in the matter. The Commission directs its Registry to transmit the copy of complaint to the concerned authority calling for an action taken report within four weeks. The concerned authorities shall also intimate the Commission, if any, notice, order etc., has been received by him/them in the instant matter from the State Human Rights Commission? If yes, a copy of such order be also sent to the Commission within four weeks. Let a copy of the complaint be also transmitted to the Secretary of the concerned State Human Rights Commission, calling upon him to inform this Commission the date of cognizance, if any, taken at their end in the instant matter within four weeks. |

The complainant, based on media reports, has invited attention of the Commission to cruel /inhuman treatment of a victim by her relatives in presence of her husband for reason of her being from lower caste. The incident is stated to have happened on 21.7.2022 in an area under PS- Madanpur , District-Deoria(UP) wherein the woman was scuffled and attacked with weapons by her relatives/in laws. It is further alleged that the accused had even inserted rod/stick inside the woman's genitals and an attempt was made to set her on fire. The complainant is seeking intervention of the Commission in the matter. The Commission directs its Registry to transmit the copy of complaint to the concerned authority calling for an action taken report within four weeks. The concerned authorities shall also intimate the Commission, if any, notice, order etc., has been received by him/them in the instant matter from the State Human Rights Commission? If yes, a copy of such order be also sent to the Commission within four weeks. National Human Rights Commission ordered compensation of Rs 3 lakh on the death of victim Jaswa Devi's husband in police beating
The complainant alleged that a 52 years old dalit man, Pradeep Choudhary, was beaten to death by police official who tried to put colour on an upper class man on holy festival. The complainant seeks intervention of the Commission in this matter. On the direction of the Commission the Investigation Division of the Commission analysis the case file and submitted its report which suggests that the deceased, Pradeep Choudhary, fell down during chaos as the police was called by the Chowkidar (on duty) over colour use during the Holi festival. He suffered head injury due to fall. The deceased was taken to the Community Health Centre, for treatment, where he was provided primary treatment. During examination, he was found under influence of alcohol. He was taken to the PS, without making any entry in the diary of the PS. In the morning, the deceased suffered three epilepsy attacks, but he was not given any medical treatment by the police. He was then released to the village Pradhan and elders. However, he again suffered epilepsy attack and his health condition deteriorated. He was referred to Sadar Hospital, Koderma. The Sadar Hospital, Koderma, further referred him to RIMS, Ranchi, for treatment. The victim died on the way to the hospital on 14.03.2017. The Enquiry Report shows evidence that he was put in wrongful confinement at the PS and was not provided treatment despite his health condition. The SP, Koderma, had initiated departmental enquiry against the then SHO of PS Satganva, for the negligence and human rights violation of the deceased. The Commission held that police failed to lodge any detail in its general dairy as to why the deceased was kept in their custody, moreover it failed to provide timely treatment to the deceased despite the fact that it is the duty of the police to provide medical care to every person in their custody. Thus in this scenario, the police has violated the human rights of the deceased person in this case for which the State Govt. is vicarious liable. Therefore, issued Show Cause notice u/s 18 of the PHR Act, 1993 to the Govt. of Jharkhand through its Chief Secretary, as to why Commission should not recommend a compensation of Rs.3,00,000/- (Rs. Three Lakh only), to the NoK of the deceased victim, Pradeep Choudhary. Vide proceedings dated 10.07.2020, the Commission observed that another similar complaint on same subject matter was received from Sh. Onkar Vishwakarma, Human Rights Activist, Koderma through email. Hence Commission had linked the same with this file. A report dated 04.09.2020, was received from the Jt. Secretary, Govt. of Jharkhand, along with the report dated 27.08.2020, from DGP, Jharkahnd, vide which was informed that the after the enquiry, the then SHO, PS Satganva, was found guilty and a punishment of "stoppage to pension for two years and reducing the pension amount by 5%" was imposed upon him. Vide another communication dated 10.12.2020, the Jt. Secretary, Govt. of Jharkhand, addressed to the Dy. Superintendent of Police, Koderma, and Police Commissioner, Koderma, details like, name, address, bank account, etc., of the NoK of the deceased victim, Pradeep Choudhry, were sought for, so that the compensation amount of Rupees Three Lakhs could be paid to them. The Commission vide proceedings dated 16.5.2021 observed and directed as under : - "The Commission has considered the material placed on record which reveals that in the present matter the then SHO, PS Satganva, was found guilty and a punishment of "stoppage to pension for two years and reducing the pension amount by 5%" was imposed upon him. Directions were issued to the Dy. Commissioner, Koderma and Superintendent of Police, Koderma to collect details like, name, address, bank account, etc., of the NoK of the deceased victim for making payment. However, the Commission…

With reference to your complaint dated 09/05/2020. I am directed to say that the matter was considered by the Commission on 05/07/2021. The Commission has made the following directions: |
The present matter pertains to complaint of Shri Lenin
Raghuvanshi, Convenor, People Vigilance Committee vide which he has
alleged about beating of journalists by police personnel as reported in
news report Janadesh Times on 08/05/2020. The complainant has requested
intervention of the Commission. The Commission vide its proceedings dated 25.03.2021 had directed the complainant to submit the comment upon the report dated 26.02.2021 received from the office of Superintendent of Police, Sonebhadra, Uttar Pradesh, along with associated reports wherein it is stated that NCR No. 18/2020, U/sec. 323/504 IPC was registered against the accused constables. As per CMIS records, no comments have been received from the complainant. In view of the reports, as above, and in the absence of any further comments of the complainant, further continuance of the proceedings in the matter is not called for. The case is closed. |

The victim belongs to Dalit community and the accused gang beaten him with stick very badly. The police denied to lodge complaint at first. Thereafter , the victim was murdered by the accused gang and then the FIR was lodged. Police has not taken any action on the matter before the murder of the victim. Vide previous proceeding dated 11.8.2021,a reminder was issued to the SSP, Rae Bareilly, for submission of the report. Pursuant to the directions of the Commission, a report dated 23.8.2021 has been received from the Superintendent of Police, Rae Bareilly, along with enquiry report, wherein it is stated that FIR No. 158/2020 u/s 364 IPC r/w Section 3(2)5 SC/ST Act was registered against Pramod Bajpayee and Siddharth Bajpayee on the complaint by the complainant Ram Naresh. During the enquiry, accused were arrested on 27.5.2020. The charge sheet No. 184/2020 has been filed in the concerned court. A financial relief of Rs. 8,25,000/- has been paid to the complainant Ram Naresh. No further action is required in the present matter. The Commission has perused and considered the report. Let a copy of the report be transmitted to the complainant, who may submit his comments within six weeks positively. In case the comments are not received within the stipulated time, it shall be presumed that the complainant has nothing to say in the matter.
