NHRC Seeks Action Taken Report in Death of 32-Year-Old Bhairav Tiwari During Treatment at Private Clinic in Jharkhand


 

Human rights intervention calls for examination of alleged medical negligence, accountability and compensation

The National Human Rights Commission (NHRC), India has taken cognizance of a complaint concerning the death of 32-year-old Bhairav Tiwari during treatment at a private clinic in Jharkhand and has directed the concerned authorities to examine the matter and submit an Action Taken Report (ATR) within two weeks.

The NHRC communication, dated 17 September 2026, concerns Case No. 1242/34/8/2025. The complaint was submitted by human rights defender Dr. Lenin Raghuvanshi through the HRC-NET system on 16 September 2025. The Commission forwarded the matter to the Additional Chief Secretary, Department of Health, Medical Education and Family Welfare, Government of Jharkhand, and the Deputy Commissioner, Giridih, seeking an expeditious report.

Alleged death following treatment at a private clinic

According to the complaint placed before the NHRC, Bhairav Tiwari, a resident of Malda Tiwari Tola, reportedly developed sudden and severe chest pain on 12 September 2025. He was taken to a private clinic at Pandey Dih Mod, where the complaint alleges that treatment was administered without adequate examination.

The complaint records an allegation that three injections were administered without conducting an examination, following which Bhairav's condition reportedly deteriorated. He was subsequently taken to Gawan Government Hospital, where he was declared dead.

The underlying media report preserved with the complaint describes the incident as occurring in the Gawan police-station area of Giridih, at Pandey Dih Mod. It reports that relatives and local residents protested following the death and blocked the Patna–Pihra main road.

Allegations concerning the treating practitioner

The complaint records allegations by the family and local residents that the treating practitioner was an unqualified or inadequately qualified practitioner and that the clinic was subsequently closed.

The accompanying report states that after Bhairav was taken to the government hospital and declared dead, the private clinic was reportedly closed and the doctor allegedly left the location.

These remain allegations requiring investigation. The NHRC's intervention does not itself establish medical negligence or criminal liability. Determining the cause of death, the standard of treatment provided, the qualifications and authorization of the practitioner, and whether any breach of law or professional standards occurred requires an appropriate investigation based on medical and documentary evidence.

NHRC directs authorities to investigate

After considering the complaint, the NHRC recorded that:

the allegations, if true, would constitute serious violations of human rights.

The Commission therefore directed its Registry to send the complaint to the concerned health authorities and the Deputy Commissioner, Giridih, to examine the matter and submit a report expeditiously within two weeks.

The NHRC communication specifically requests an Action Taken Report from the authorities within two weeks of receipt. It also states that public authorities should submit their communication through the HRCNet Portal, rather than relying solely upon email.

  4. Whether established medical protocols and standards were followed.
  5. Whether there was any delay in referral to an appropriate government or higher-level medical facility.
  6. Whether relevant health authorities had previously received complaints concerning the facility or practitioner.
  7. Whether the family has received information, access to records and appropriate remedy or compensation where legally warranted.

An impartial inquiry can distinguish between a tragic medical outcome, professional negligence, unauthorized medical practice and any other violation established by evidence.

Protest and demand for accountability

The accompanying Dainik Bhaskar report states that following Bhairav's death, family members and local residents protested and blocked the Patna–Pihra road. The report records demands for appropriate compensation for the family and legal action if wrongdoing was established.

The original complaint submitted by Dr. Lenin Raghuvanshi requested that the matter be examined through an impartial investigation, with justice and compensation for the affected family.

From individual tragedy to systemic accountability

The NHRC's intervention is important not because it prejudges the allegations, but because it requires the responsible public authorities to formally examine them and report the action taken.

A credible investigation should provide clarity to the family about what happened, whether the treatment provided was lawful and medically appropriate, whether regulatory mechanisms functioned effectively, and whether any person or institution bears responsibility.

The case also illustrates the role that human-rights documentation can play in bringing allegations involving healthcare access, patient safety and institutional accountability before a statutory human-rights institution.

The next stage

The immediate procedural step is the submission of the Action Taken Report by the Jharkhand authorities within the period stipulated by the NHRC.

The report should ideally address the factual circumstances of Bhairav Tiwari's death, the medical and forensic evidence available, the status of any police or departmental inquiry, the credentials and authorization of the treating practitioner, the action taken by the health department, and the question of relief or compensation for the family.

A complaint dated 16.09.2025 has been received from Lenin Raghuvanshi, r/o SA4/2A Daulatpur, Pandepur, Varanasi, Uttar Pradesh, in the Commission through HRC-NET on 16.09.2025, containing that:

The complainant submits that a 32 year old man, Bhairav Tiwari, resident of Malda Tiwari Tola, Giridih, Jharkhand, died due to alleged negligent treatment by a private doctor. He alleges that on 12.09.2025 at Pandey Dih Mod, Giridih, Bhairav suffered sudden chest pain and was taken to the clinic of Dr Hari Das. It is further alleged that without conducting any medical examination, the doctor administered three injections, after which the patient’s condition worsened and he was declared dead at Gawan Government Hospital, Giridih.

The complainant submits that the doctor was a quack who fled after the incident, closing his clinic. He requests impartial investigation, accountability of the doctor and responsible officials, immediate arrest of the accused, and compensation to the victim’s family.

In view of the above, the Commission is of the considered view that the allegations levelled in the complaint, if true, are serious violations of the Human Rights of the complainant/victim. Accordingly, the Registry is directed to send a copy of the complaint to the Additional Chief Secretary, Department of Health, Medical Education and Family Welfare, Government of Jharkhand and the Deputy Commissioner, Giridih, Jharkhand, to examine the matter and submit the report expeditiously within a period of two weeks.

 
2.      Accordingly, I am forwarding herewith a copy of the complaint/ intimation as an attachment for taking appropriate action in the matter as per the directions of the Commission. The complainant, on behalf of Smt. Shabana Khatoon, w/o Javed Sakeen, r/o Shaheed Chowk, Mahthadih, Domchanch PS, Koderma, Jharkhand, states that her minor son Junaid Ansari was killed by his peers after being forcibly taken to a dam. The complainant alleges that on 05.09.2025, accused boys Asif Ansari (15), Sagar Kumar (16), Ankit Kumar (16), Sonu Kumar (15), Anmol Kumar (15), and Nitish Kumar (15), all residents of Shaheed Chowk, lured Junaid to Chandravati Smarak High School ground and later to a dam.

The complainant submits that at the dam, Ankit, Anmol, and Sonu allegedly forced Junaid into deep water, assaulted him, and drowned him, citing prior school disputes. It has been alleged that despite recovery of Junaid’s body and a complaint filed on 07.09.2025 at Domchanch PS, no FIR was registered. The complainant requests immediate registration of FIR under relevant penal provisions, strict investigation against the named accused, and compensation to the family.

In view of the above, the Commission is of the considered view that the allegations levelled in the complaint, if true, are serious violations of the Human Rights of the complainant/victim. Seeking accountability and protection of children’s human rights

The National Human Rights Commission (NHRC), India has taken cognizance of a complaint concerning the death of 16-year-old Junaid Ansari of Shaheed Chowk, Mahthadih, Domchanch, Koderma, Jharkhand, and has directed the Deputy Commissioner and Superintendent of Police, Koderma, to inquire into the allegations and submit an Action Taken Report (ATR) within two weeks.

The case, NHRC Case No. 1243/34/12/2025, relates to a complaint submitted by human rights defender Dr. Lenin Raghuvanshi concerning allegations surrounding the death of Junaid. The NHRC communication dated 17 September 2026 records that the complaint was received through HRC-NET and subsequently placed before the Commission.

According to the NHRC's communication, the allegations, if true, constitute serious violations of the human rights of the victim and complainant. The Commission therefore directed its Registry to forward the complaint to the district authorities for an inquiry and an expeditious report. The Commission has specifically allowed two weeks from receipt of its communication for submission of the ATR.

Allegations concerning the death of Junaid

The complaint relates to an incident in which Junaid was allegedly taken from his home by other boys after being lured to the school playground and subsequently to a dam.

The original application submitted by Smt. Shabana Khatoon, Junaid's mother, to the Superintendent of Police, Koderma, describes the circumstances in detail. The two-page application, dated 9 September 2025, states that on 5 September 2025 Junaid was allegedly taken away by boys from the locality. It further alleges that after reaching the dam, Junaid was forced into the water and that several boys were involved in the incident. The application states that Junaid ultimately drowned. The application further states that Junaid's body was recovered after the incident and that the family approached Domchanch Police Station on 7 September 2025 seeking legal action. The family alleged that no FIR had been registered by 8 September 2025 and expressed concern regarding the seriousness with which the matter was being treated by the police.

The original complaint is significant because it represents the family's contemporaneous account and request for criminal investigation. The NHRC subsequently recorded these allegations in its proceedings.

NHRC intervention

The NHRC's intervention places the matter within the framework of the State's responsibility to protect the life, dignity and security of children.

In its order, the Commission observed that if the allegations are true, they constitute serious human-rights violations. It consequently directed the district administration and police authorities to inquire into the matter and submit an ATR expeditiously.

The Commission's communication also makes clear that the authorities are expected to submit their response through the HRC-NET Portal, using their official authority credentials. Responses sent merely by email may not be entertained, according to the NHRC communication.

The case therefore moves from a complaint by the victim's family and human rights intervention toward an institutional examination by the district authorities.

Effective accountability requires that allegations be independently investigated, evidence preserved, responsible persons identified where evidence establishes responsibility, and victims' families provided access to justice and appropriate remedies.

The NHRC's direction is therefore an important procedural development in the Junaid Ansari case. The next significant step is the Action Taken Report from the Koderma authorities, which should clarify what investigation has been undertaken, what criminal-law action has been initiated, the status of the FIR and investigation, the steps taken concerning the persons named in the complaint, and whether relief or compensation has been considered for the family.

Continuing the struggle for dignity and justice

The death of a child leaves a permanent impact on the family and community. A human-rights response must go beyond recording the death. It must seek truth, accountability, remedy and institutional learning so that similar failures do not recur.

The NHRC's 17 September 2026 communication in Case No. 1243/34/12/2025 represents a formal step toward obtaining an accountable response from the Koderma administration and police.

Justice for children requires not only protection before violence, but accountability when a child's right to life is violated.
