These proceedings shall be read in
  continuation of earlier proceedings of the Commission dated 20.9.2017 vide
  which the Commission directed to Issue notice u/s 18(a)(i) of the PHRA, 1993
  to the Govt. of Uttar Pradesh through its Chief Secretary to show cause as to
  why the Commission should not recommend monetary relief to the victims. No
  reply to show cause notice has been submitted by the State Government. It is
  presumed that the State Government has nothing to say in the matter. Vide
  proceedings dated 20.9.2017, the Commission observed that “a report dated
  11.11.2016 has been received from the Superintendent of Police, (Human
  Rights) along with a copy of the report dated 02.11.2016 submitted by the
  DIG, Varanasi Range, Varanasi in which stated that during enquiry conducted
  into the matter, the then S.O. Ratan Singh Yadav was found guilty of keeping
  Pancham Yadav, Pappu Yadav, Balram Yadav and Shankar Yadav in
  illegal/unauthorized custody in the police station. It is further stated that
  he has been punished by an entry of censure”. The Commission has perused and
  considered the report. In the opinion of the Commission a clear case of
  violation of human rights of the victims is made out and the State Government
  is liable to pay adequate compensation to the victims. Keeping in view the
  facts and circumstances of the case, the Commission recommends to the
  Government of Uttar Pradesh, through its Chief Secretary, to pay compensation
  of Rs.2,00,000/- to the victims. The Chief Secretary, Government of Uttar
  Pradesh is directed to submit compliance report along with proof of payment
  within six weeks.
