NHRC Seeks Action Taken Report in Alleged Custodial Torture and Extortion Case from Badaun, Uttar Pradesh


The National Human Rights Commission (NHRC) of India has taken cognizance of a serious complaint alleging illegal detention, custodial torture, and extortion by police personnel in Badaun district of Uttar Pradesh. On 5 February 2026, the Commission directed the Senior Superintendent of Police (SSP), Badaun to submit an Action Taken Report (ATR) within four weeks.

Background of the Complaint

The complaint (Diary No. 14029/IN/2025, Case No. 17373/24/7/2025) was submitted on 16 June 2025 by Lenin Raghuvanshi, Convenor of the People’s Vigilance Committee on Human Rights (PVCHR), based in Varanasi.

The victim, Jalees Miya (40 years), a resident of Village Bari Samspur, Police Station Binawar, District Badaun, alleged that he was:

  • Illegally detained by police in connection with a murder investigation

  • Subjected to custodial torture

  • Extorted ₹12 lakh through an intermediary in exchange for relief from false implication

The incident reportedly occurred at Police Station Kunwargaon, Badaun, on 15 June 2025.

Allegations Against Police Officials

According to the complaint placed before the NHRC, the accused include:

  • The former Station House Officer (SHO), Kunwargaon

  • Members of the SOG (Special Operations Group)

  • Other unnamed police personnel

The complainant stated that after approaching senior police authorities, the matter was assigned to the SP (Crime), Badaun for investigation. However, given the gravity of the allegations and the involvement of police officials, the complainant sought the NHRC’s intervention to ensure accountability and impartial inquiry.

NHRC’s Direction

After perusing the complaint on 5 February 2026, the Commission observed that the allegations raise serious human rights concerns, particularly involving:

  • Abuse of police power

  • Custodial violence

  • Extortion under the guise of criminal investigation

The NHRC directed that:

  • A copy of the complaint be forwarded to the SSP, Badaun

  • The SSP must submit an Action Taken Report (ATR) within four weeks

  • The matter be listed again after four weeks for further consideration

The directive was issued by Indrajeet Kumar, Deputy Registrar (Law), NHRC, through official communication sent via email and the HRCNet process.

Significance of the Case

Custodial torture and illegal extortion strike at the heart of the rule of law and violate Articles 14, 21, and 22 of the Constitution of India, as well as India’s obligations under international human rights standards.

This case underscores the continued vulnerability of marginalized individuals to police excesses and the importance of independent oversight mechanisms like the NHRC. The Commission’s intervention offers a critical opportunity to ensure:

  • Accountability of erring officials

  • Protection of the victim and witnesses

  • Restoration of public trust in law enforcement

Way Forward

PVCHR has welcomed the NHRC’s intervention and emphasized the need for:

  • A time-bound, impartial investigation

  • Protection from reprisals for the victim and family

  • Criminal prosecution and departmental action against guilty officials

  • Compensation and rehabilitation for the survivor of custodial abuse

Civil society organizations and human rights defenders will continue to monitor the case closely to ensure that the NHRC’s directions translate into meaningful justice on the ground.

        The complaint/ intimation dated 16/06/2025, was placed before the Commission on 05/02/2026. Upon perusing the same, the Commission directed as follows:
 
         

The complainant alleges that in Badaun, a person was illegally detained and tortured by police in connection with a murder case, and 12 lakh was extorted from him through an intermediary. The complainant approached senior police authorities, who have assigned the case to the SP Crime for investigation. The accused include the former Kunwargaon SHO, SOG team members, and other police personnel.


Let a copy of complaint be transmitted to the SSP, Badaun, UP calling for an Action Taken Report within four weeks.

Put up after four weeks.
