Sir,

The Complaint dated 09/08/2011 was placed before the Commission
on 09/08/2011. Upon perusing the complaint, the Commission directed as
follows:

The complainant in his complaint dated 09.08.2011 referred to a web
link vide which it has been alleged that one Ashok Kumar was shot dead
by SPO and Army personal showing him as a terrorist of Lashkar-e-Taiba
named Abu Usman @ Abu Adnan @ Doctor on 07.08.2011 in Poonch District
of Jammu & Kashmir. Another complaint in this regard has been received
from Shri R. H. Bansal in the same matter. Both the complaints be
linked together. The Director General of Police, Jammu & Kashmir,
District Magistrate, Poonch, Supdt. of Police, Poonch and Secretary,
Ministry of Defence, Govt. of India, New Delhi are directed to take
appropriate action with regard to the investigation of the case as per
guidelines laid down by the Commission in its letter dated 12th May,
2010 of the Acting Chairperson, NHRC to the Chief Ministers of all the
States. Magisterial enquiry report, post-mortem report along with
report of independent investigation be submitted to the Commission
within eight weeks. The Supdt. of Police, Poonch also be asked to
explain as to why the intimation regarding the death in police action
was not reported to the Commission within 48 hours in the prescribed
format. A copy of the Commission's letter dated 12th May 2010 be sent
for their ready reference.

2. Accordingly, I am forwarding herewith a copy of the complaint for
taking appropriate action in the matter as per the directions of the
Commission. It is requested that an Action Taken Report be sent to the
Commission within from the date of reciept of this letter.
